Beresford Booth Litigators Win Favorable Jury Verdict in Timber Trespass Trial


On September 21, 2022, Beresford Booth litigators Todd J. Cook and Kelsey L. Affronte obtained a favorable jury verdict following a 7 day trial in Snohomish County Superior Court. Cook and Affronte’s client asserted a Timber Trespass claim based on the unauthorized removal of the client’s nearly 200-foot privacy hedge that separated two lake front properties in Snohomish County. The 12-person jury returned a $119,000 verdict in favor of the Plaintiff representing restoration costs and emotional distress damages. Under Washington’s Timber Trespass Statute, RCW 64.12.030, the verdict is “trebled” (tripled) to $357,000.
