Recent Washington Legislative Update concerning Estate Planning and Probate – Part 4

As we are entering into June 2024, a number of new laws enacted this year will soon become effective, including SHB 2347 concerning adult family home information on the Department of Social and Health Services website. This bill was signed by the Governor on March 25, 2024, and will become effective on June 6, 2024.  If you have family members staying at an adult family home, or if you are researching on an adult family home, this new law might be beneficial to you.

The Department of Social and Health Services regularly inspects each adult family home at least once every 18 months. Upon inspection, a written report is generated by the Department of Social and Health Services. Relevant information is available for public review. Certain information is further provided on the Department’s website for the public’s easy access.

While the Department of Social and Health Services is not required to provide all inspection and investigation reports on its website, the new law helps to specify what documents and information will be provided on the website. For example, the new law requires the Department of Social and Health Services to provide the following documents for the previously three years on its website:

  • Deficiency-free inspection letters;
  • Statements of deficiency related to inspection visits requiring an attestation correction;
  • Statements of deficiency related to enforcement actions;
  • Notices of return to compliance related to statements of deficiency; and
  • Enforcement action notices issued by the Department of Social and Health Services.
